TERMS OF SERVICE – DIGITAL PHOTOGRAPHS

These Terms of Service (“Terms”) govern the sale and use of digital photographs (“Images”) purchased from the Photographer.

By purchasing, downloading, or using the Images, you agree to be bound by these Terms.

1. Products

The Photographer offers digital photographic images taken at go-karting and motorsport events.

All Images are supplied in digital format only unless otherwise agreed.

2. Payment

• All prices are listed in GBP (£) unless stated otherwise.

• Payment must be made in full before Images are delivered.

• Images will not be released until payment has been received and cleared.

3. Delivery

• Images are delivered electronically via download link or email.

• Delivery times are estimates and may vary.

• The Photographer is not responsible for delays caused by technical issues outside their control.

4. No Refunds

In accordance with the Consumer Contracts Regulations 2013, digital content supplied immediately after purchase is non-refundable once delivery has begun.

By purchasing the Images, you:

• Acknowledge that the Images are digital content, and

• Agree that all sales are final and no refunds, returns, or exchanges will be provided once Images are delivered.

5. Copyright & Ownership

• All Images remain the exclusive property and copyright of the Photographer under the Copyright, Designs and Patents Act 1988.

• No copyright or ownership is transferred to the Buyer.

• The Buyer is granted a limited licence to use the Images as set out below.

6. Licence Granted (Personal Use Only)

The Buyer is granted a non-exclusive, non-transferable, perpetual licence for personal use only.

The Buyer may:

• Post Images on personal social media accounts

• Display Images on personal websites or non-commercial driver profile pages

• Print Images for personal display

7. Mandatory Social Media Credit

When posting Images on social media, the Buyer must tag or credit the Photographer.

Acceptable credit includes:

• Tagging the Photographer’s official social media account, or

• Written credit: Photo © [Your Name / Business Name]

Failure to provide credit constitutes a breach of these Terms.

8. Editing & Alterations

• Editing or altering the Images is strictly prohibited

• This includes, but is not limited to:

  • Cropping or reframing

  • Filters or presets

  • Colour, exposure, or contrast changes

  • Adding text, logos, or graphics

  • Removing watermarks or metadata

Any modification requires prior written permission from the Photographer.

9. Prohibited Uses

The Buyer must not:

• Use Images for commercial, promotional or advertising, purposes

• Sell, license, distribute, or share the Images

• Use Images on merchandise or products

• Use Images for AI training, NFTs, or stock libraries

Commercial or sponsor use requires a separate written licence.

10. Termination

Any breach of these Terms will result in immediate termination of the licence, and the Buyer must cease all use of the Images.

11. Limitation of Liability

To the maximum extent permitted by law:

• The Photographer shall not be liable for indirect or consequential losses.

• The Photographer’s total liability shall not exceed the amount paid for the Images.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

13. Acceptance of Terms

By purchasing and downloading the Images, the Buyer confirms that they have read, understood, and agreed to these Terms of Service.
